Announcement Regarding Appeals/Investigation

The Claims Conference has appointed Justice Herman Cahn, formerly of the New York Supreme Court, to adjudicate appeals from persons whose payments have been deemed fraudulent.

The Claims Conference has informed each affected person of their right to submit an appeal. An appeals procedure headed by Justice Cahn has been established.

Justice Cahn was first elected as Judge of the Civil Court of the City of New York in 1976.  He subsequently served as an Acting Justice of the Supreme Court from 1980 until 1992, when he was elected to the Supreme Court.  Justice Cahn was instrumental in the creation of, and a founding Justice in, the Commercial Division within the New York State Supreme Court.  He served as a Justice of the Commercial Division from its inception in 1993 until joining Milberg LLP as Of Counsel.

The appeals process is ongoing, as is the Claims Conference’s investigation of fraudulent applications to compensation programs. The investigation by federal law enforcement authorities also continues. The Claims Conference will issue an update by December 31, 2010.
